Overview

Umaymah Salasa-Khan is a senior associate in our Cape Town office Dispute Resolution Department.

She specialises in commercial litigation, arbitrations, contractual disputes, corporate recovery and restructuring. Umaymah has extensive experience in business rescue and has experience in tax litigation and insolvency/ bankruptcy law. Umaymah was part of the team that represented the Overseas Shipholding Group in its successful application for the recognition of a United States bankruptcy order and certain provisions of the foreign bankruptcy law. The order created new law in South Africa in respect of cross-border insolvency cases.

She has B.Soc.Sc and LLB degrees from the University of Cape Town.

 

Specialist Services

Relevant Experience

  • Commencing business rescue proceedings for the Moyo group of companies and advising the Business Rescue Practitioners on all aspects pertaining to the business rescue. Five restaurants successfully exited business rescue while three others were liquidated. 
  • Launching an application to commence business rescue proceedings for a private company which owns an inactive gold mine in South Africa on behalf of the majority creditor and sole shareholder of the company and providing strategic advice to the Business Rescue Practitioners on all aspects of the business rescue.
  • Providing strategic advice to the Business Rescue Practitioners of two private companies primarily involved in invoice discounting, single and selective invoice financing and inventory financing. The advice pertained to the validity of alleged claims against the companies and negotiating a settlement between the companies and affected parties. These two companies were successfully discharged from business rescue.
  • Acting on behalf of the Overseas Shipholding Group in its successful application for recognition of a United States bankruptcy order and certain other provisions of the foreign bankruptcy law. The order in this matter created new law in South Africa in respect of cross-border insolvency cases.
  • Acting on behalf of Excel Maritime Carriers Ltd in its successful application for recognition of a United States bankruptcy order and certain other provisions of foreign bankruptcy law.
