A CLOSER LOOK AT THE COMESA COMPETITION COMMISSION

On 14 January 2013, COMESA’s Competition Commission announced that it was operational and ready to receive merger notifications. The announcement was unexpected and there are no transitional provisions. The monetary thresholds for notification have been set at zero. In addition, although COMESA is clearly expected to be a one-stop-shop for merger notification in the COMESA region, it appears that some of the national competition authorities believe that they still have jurisdiction, leaving merger parties with considerable uncertainty as to whether they should file with the national competition authorities, the COMESA Commission or both.
