CONSTITUTIONAL COURT CONFIRMS THE LIMITED RIGHT TO LEGAL REPRESENTATION IN THE CCMA

This week the Constitutional Court handed down an order in the matter of The Law Society of the Northern Provinces v The Commission for Conciliation, Mediation and Arbitration & Others, CCT 136/13. In the Constitutional Court the Law Society sought leave to appeal against the judgment and order of the Supreme Court of Appeal (SCA) in which the SCA ruled in favour of the CCMA and confirmed the constitutionality of Rule 25(1)(c) of the Rules of the CCMA (the Rule), which limits the right to legal representation in CCMA dismissal arbitrations.
