KENYA PASSES ITS FIRST DATA PROTECTION ACT

Following on from our update on the progress of the Data Protection Bill 2019 in August 2019 (click here), The President of Kenya Uhuru Kenyatta approved and signed into law Kenya’s first Data Protection Act 2019 on Friday 8th November 2019.

The signing into law of this legislation is a development that has been highly anticipated for the last few years.  It further signals Kenya’s commitment to meeting international data protection standards that, since the introduction of the EU’s General Data Protection Regulation, have been at the forefront of policy making for governments, public and private institutions and of increased interest to individuals. It is likely that this new piece of legislation will introduce new regulatory and compliance challenges for a multitude of organisations and individuals doing business in Kenya.

As at the date of this newsflash, the Data Protection Act 2019 has not yet been gazetted and we will provide a further detailed analysis as and when this is made publically available.
