In the Oceanic Trust Co Ltd NO v C: SARS (2011) 74 SATC 127 (“Oceanic Trust case”) the Tax Court commented on the concept “place of effective management” (“POEM”). Although the case dealt with the POEM of a trust, the comments are relevant to companies too.
