PUBLICATION (BUT NOT THE COMMENCEMENT) OF THE ELECTRONIC COMMUNICATIONS AMENDMENT ACT AND THE ICASA AMENDMENT ACT

There are pending amendments to the two statutes, namely the Electronic Communications Act 36 of 2005 (ECA) and the Independent Communications Authority of South Africa Act 13 of 2000, governing telecommunications and broadcasting networks and services and the Independent Communications Authority of South Africa (ICASA). In this regard, the Electronic Communications Amendment Act 1 of 2014 (EC Amendment Act) and the Independent Communications Authority of South Africa Amendment Act 2 of 2014 (ICASA Amendment Act) were signed by the President on 3 April 2014, and were published in the Government Gazette on 7 April 2014. The date of commencement of the EC Amendment Act is still to be set by the Minister of Communications. Different sections may commence on different dates. The date of commencement of the ICASA Amendment Act is still to be set by the President. These dates of commencement will be published in the Government Gazette in due course.
