Overview

Humayra Hajat is an Associate in our Technology, Media and Telecommunications Practice at our Johannesburg office.

Humayra advises a number of local and international clients on regulatory aspects of TMT. The areas of law in which she advises include telecommunications, data protection, cybercrimes, state surveillance law, consumer protection primarily in the context of electronic communications and transactions and online platforms, films and publications, and broad-based black economic empowerment (BBBEE) in the ICT sector.

She has BA, LLB (with distinction) and LLM in Corporate Law degrees from the University of Witwatersrand.

Relevant Experience

  • Acted for a mobile network operator in the spectrum litigation which ultimately set aside the invitations to apply for International Mobile Telecommunications spectrum published by the Independent Communications Authority of South Africa (ICASA) in 2020.
  • Assisted a mobile network operator with its submission to ICASA in relation to the temporary spectrum assignments issued under the ICT COVID-19 National Disaster Regulations, 2020.
  • Assisted a private equity fund with its submission to ICASA for its application for approval of the transfer of control of a fibre network operator’s individual licences under the Electronic Communications Act 36 of 2005 (the ECA).
  • Assisted a Big Tech company with data protection advice in relation to various new features and products.
  • Assisted a multinational telecommunications company with its data transfer risk impact assessment.
  • Assisted a major on-demand streaming provider with its submission to the Minister of Communications and Digital Technologies (the Minister) on the Draft White Paper on Audio and AudioVisual Content Services Framework.
  • Assisted a venture capital industry association with its submission to the Minister on the Draft National Data and Cloud Policy.
  • Assisted several international clients with telecommunications advice as it relates to the licensing framework under the ECA.
  • Assisted several multinational companies with their engagements with the BBBEE Commission.
  • Assisted several multinational companies with their data protection compliance audits.
  • Assisting several international companies with local reviews of their data processing addenda and data transfer agreements.
  • Assisting a major software-as-a-service provider with advice in relation to electronic signatures and electronic agreements.
  • Assisting a major local retail pharmacy with standard data protection clauses in certain of its agreements.
  • Assisting a multinational consumer electronics company with data protection advice and data protection agreements.
  • Assisting a luxury vehicles company with advice in relation to consumer protection in the context of an online platform, and data protection advice.
  • Assisted on several due diligences across a number of industries including telecommunications, oil and gas and payment services, notably Network International’s proposed acquisition of the DPO Group.
  • Assisted a major on-demand streaming provider with its submission to the Films and Publication Board in relation to certain amendments to the Films and Publications Act 65 of 1996.
  • Assisted a Big Tech company with type approval requirements under the ECA.
