Overview

Mary-Rose Mafalo is an associate in our Dispute Resolution Department and a member of the Corporate Investigations Practice.

Mary-Rose joined Bowmans in 2019, having previously worked as an Adjudicator for the Ombudsman for banking services.

Prior to the above MaryRose worked as a  Legal Consultant for the South African Reserve Bank.

Mary-Rose’s experience of 4+ years makes her level Senior Associate as per the AGSA fee structure.

Ombudsman for Banking Services

  • Assessing and investigating disputes between member banks and their clients
  • Drafting of assessments
  • Collating and submitting evidence for each dispute matter
  • Negotiating outcomes and settlements
  • Liaising with all relevant parties to ensure the dispute is resolved timeously
  • General administration of case management

South African Reserve Bank

  • Receiving complaints from the general public and other reporting institutions pertaining to possible contravention of the Banks Act by receiving Illegal deposits;
  • Assessing whether the complaints could be a contravention of the Banks Act;
  • Drafting legal opinions;
  • Attending to legal issues;
  • Conducting research;
  • Appointing investigators;
  • Referring matters to relevant institutions for further investigations and possible prosecution;
  • Liaising with relevant institutions including but not limited to law firms, forensic investigators, the South African Police Services, the National Prosecuting Authority, the Financial Sector Conduct Authority, the Financial Intelligence Centre and the National Consumer Commission;
  • Drafting of the divisional working manual;
  • In-house training of new staff members;
  • Committee member of the inter-governmental working group for illicit flow of funds, the group consist of the South African Revenue Services, South African Reserve Bank, National Prosecuting Authority, Financial Intelligence Centre, Directorate for priority crime investigation (Hawks) and South African Police Services with the aim of combating the illicit flow of funds from leaving South Africa;
  • Receiving, reviewing and granting of licenses for Mutual banks, Commercial Banks, Insures; and
  • Drafting the department’s working manual regarding insurance procedures.
